Terms & Conditions 

  

  1. Booking Information 

    1. The ‘Hirer’ means the person signing the booking form for Hire of Equipment.

    2. '40winks Parties’ is a trading name and refers to Charlotte Souter and Jennifer Leahy. 

    3. Provisional bookings for parties booked more than 14 days in advance will be held for 48 hours; party dates not confirmed within these times will be released. Parties booked within 14 days of the party date will require immediate full payment. 

    4. A non-refundable deposit of £50 and a completed booking form is required to confirm the booking and the remaining balance is due 7 days prior to the party date.  

    5. A refundable £50 damage deposit is due 7 days prior to the party date. After the party has finished and 40winks has checked there is no damage, the damage deposit will be returned in full, normally within 48 hours. If there is any damage the Hirer will be notified of the details and the cost of repair/replacement which will be deducted from the damage deposit before it is returned.   

    6. The Hirer must disclose the property type and access to the venue when booking.  

    7. The Hirer is responsible for providing 40winks Parties’ staff with all relevant medical/dietary information for all of the children attending the party. 40winks Parties takes no responsibility for allergies (including skin, food, materials etc.) where we are not advised in advance of the condition. Likewise, we are not responsible at any point for the welfare of the children at the parties, which remains the full responsibility of the Hirer. 

    8.  The Hirer is responsible for ensuring the accuracy of the information given to 40winks Parties and to pass over such information in sufficient time for 40winks Parties to perform the contract safely and without risk, more than 14 days prior to the party date, to avoid last minute disappointment. 

    9. The Hirer is responsible for ensuring adequate indoor space is available for the equipment to be set up and arranged. The space required for one tent and one mattress is a minimum of L140 x W90cm. If there is room of up to 180cm in length we can place the breakfast trays in front of each bed, however, these can be placed elsewhere if needed. If you have space and older children we can provide longer mattresses of L160cm x W90cm. 

    10. 40winks Parties reserves the right to make any changes to the services as it deems necessary without notice to the Hirer. If the required services is less than originally requested the appropriate refund will be made to the Hirer. 

    11. The Hirer is responsible/liable for any damage or injury occurring from or as a result of inappropriate use or misuse or reckless use of any 40winks Parties’ equipment. 

    12. Smoking is not permitted in the proximity of 40winks Parties’ equipment 

    13. It is the Hirer’s responsibility to ensure the children comply with all reasonable instructions from 40winks Parties’ employees to ensure the safety of the attendees and other persons present.  

    14. 40winks Parties will accept no liability or responsibility to the Hirer for any damages, costs, losses, claims, expenses, demands and proceedings including property of the Hirer, or any third party and their guests, or any consequential loss in these regards. 

    15. 40winks Parties shall use all reasonable endeavours to provide the services in accordance with the contract and shall perform services with reasonable skill, care and diligence 

    16. 40winks Parties shall process all data in accordance with the Data Protection act 1998. 

    17. Some produce used may contain traces of nuts or may have been made in a factory that handles nuts. Please carefully check all ingredients before use/application. 
       

  2. Supervision 

    1. The Hirer is responsible for the care and safety of all the children and should ensure that all parents/guardians are aware that 40winks Parties are not responsible for the care and safety of the children. 

    2. The Hirer will be required to take responsibility for all children that have been left by their parents. 

    3. We recommend that the Hirer of the party take contact telephone numbers of the children attending if their parents/guardians are not staying at the same time as clarifying any medical/allergic conditions at least 14 days in advance of the event. 

    4. In the interest of health and safety, domestic pets are not allowed access to the hire equipment. Any additional cleaning as a result of access to the equipment by pets may result in an additional charge. 
       

  3. Cancellation (by the Hirer) 

    1. In the unfortunate event that party is cancelled the following refund policy will be applied: 

    2. Cancellation of a booking up to 14 days prior to the party will forfeit the deposit paid 

    3. Cancellation of a booking between and including 13 and 7 days prior to the party will be refunded 25% of the total monies paid 

    4. Cancellation of a booking after the dates specified will unfortunately forfeit all monies paid. 

    5. Cancellation because of COVID19 (testing positive or displaying symptoms) will result in rescheduling the party at the next available date.
       

  4. Cancellation (by 40winks Parties) 

    1. 40winks Parties reserves the right to cancel the booking at any time for any reason (40winks will try to give as much notice as possible). 

    2. Upon any such cancellation 40winks Parties will refund to the Hirer any monies paid to 40winks Parties in respect of the booking, but 40winks Parties will not be liable to pay any compensation to the Hirer or any other person for any loss, damage or expenditure arising directly or indirectly from the cancellation. 

    3. 40winks Parties reserves the right to terminate the booking without notice if there is a breach of these conditions.  
       

  5. Liability 

    1. Nothing in these terms shall limit or exclude the liability of 40winks Parties, which may be limited or excluded by law, including without limitation liability for death or personal injury caused by 40winks Parties’ negligence or fraudulent misrepresentation. 

    2. Subject to the above 40winks Parties shall have no liability (whether arising under contract, tort, or for breach of statutory duty or otherwise) to the extent that such liability would not have arisen but for the Hirer’s breach of contract. 

    3. Subject to the above clauses 40winks Parties aggregate liability for all claims in relation to the contract (whether arising under contract, tort, or for breach of statutory duty or otherwise) shall not exceed the price paid by the Hirer. 

    4. This contract is governed and constructed in accordance with English law and the parties irrevocably submit to the exclusive jurisdiction of the courts of England. 

    5. No information included in this booking form will be disclosed to any third party. 

    6. It is the responsibility of the Hirer to inform guests accordingly of the above terms and conditions. 

    7. 40winks Parties has suitable public liability insurance and takes the upmost care to ensure the safety of all party guests at all times. 40winks Parties’ tents and canopies are independently tested and marked CE in accordance with the Toy Safety regulations UK 2011. 

    8. We use high quality products and follow strict hygiene routines. 

    9. Liability cannot be taken for reactions or injury sustained whilst attending a party or thereafter. 

    10. All persons using 40winks Parties do so at their own risk and it is the party hirer who is responsible for any damage or injury occurring as a result of inappropriate use or misuse or reckless use. 

    11. This information is given for the safety of all people attending a party hosted by 40winks Parties and it is the sole responsibility of the Hirer to ensure that they are understood and adhered to by all invited party guests. 
       

  6. Covid-19 

    1. During the Covid-19 pandemic, 40winks Parties has added an addendum (please see covid policy) to these terms to outline how it is responding to the pandemic.
